1.
This agreement is effective:
through thirty days after the building opens between:
(hereinafter “Community”)
(hereinafter “resident(s)”). A new Reservation Agreement must be completed in order to retain a right of first refusal for any other duration of time – see #6.

(hereinafter “apartment”)
for the resident(s) in exchange for a security deposit of $100 to be applied against first month’s rent. A new Reservation Agreement must be completed in order to retain a right of first refusal for any other apartment – see #6.
3.
The security deposit is fully refundable up to the date the resident contract is signed and the resident(s) take(s) financial possession of the apartment. It is the responsibility of the resident(s)/responsible party to request the refund in writing. The Community will have 30 days to process the refund from the date the refund is requested.

as of date of this agreement. Monthly rent does not include care or ancillary services. Rates are subject to change and in no way should the monthly rent listed above be considered a “rate lock” through the reservation period or any period thereafter. Actual monthly rent will be determined as of the date the resident contract is signed and the resident(s) take(s) financial possession of the apartment. The resident(s) reserve the right to terminate this agreement upon notification by the Community of any change to the monthly rent listed above and receive a refund – see #3.
5.
This agreement confirms that the resident(s) retain a right of first refusal for the apartment until the reservation period ends. In the event the resident(s) does(do) not move in by the end of the reservation period the resident(s) lose the right of first refusal to the apartment. The Community may show the apartment but will refrain from offering the apartment to prospective residents until the reservation end date or the resident(s) move in date, whichever is earlier.
6.
The right of first refusal will only attach to the apartment and reservation period selected per the most current signed Reservation Agreement. The most current signed Reservation Agreement nullifies prior existing signed Reservation Agreement(s). Any apartment or reservation period change authorized outside of a signed Reservation Agreement will not automatically attach a right of first refusal.
